When homeowner Justin Hamel hired Paulson’s Construction to do some simple home improvement work he never dreamed a year later he would be sitting with a master bathroom that had to be remodeled for the second time, a lawsuit for defamation, and a lot less money in his pocket.

“I paid Paulson’s Construction close to $20 thousand dollars and now I have to pay somebody else to remodel my bathroom again! I also have to pay lawyers to fight a defamation lawsuit for posting my experiences.” Said homeowner Justin Hamel. Hamel isn’t the first person sued for defamation over an online review, Jane Perez was sued by a contractor for posting a negative review on yelp.com about missing jewelry as reported by Huffington Post December 6th, 2012.

According to a report from Kirotv on August 9, 2011 about a different Seattle case where a landlord filed suit against a Yelp reviewer, “Whatever the reason for the lawsuit,” attorney Josh King, vice president of Avvo.com, a website where consumers post reviews of doctors and lawyers, says any legal action was not a good idea.

“The idea of pursuing a defamation lawsuit over an online posting is about the stupidest thing you can do as a business owner,” King said. “It simply raises the profile of the issue, it ignores an opportunity to respond to customer feedback and it lets other consumers feel that you as a business are more interested in covering up negative feedback than actually responding to it and addressing it.”

“I didn’t do anything wrong,” said Mr. Hamel. “The only thing I posted is my experiences and opinions as a customer of Paulson’s Construction.” A Google search of Paulson’s Construction shows the online reviews in question. In the reviews the homeowner Justin Hamel provides lots of pictures of the remodel work.

Justin Hamel hired Paulson’s Construction, a company owned by Paul McClorey when he needed remodel work done on his Howell Michigan home, according to the lawsuit file no. 13-2312-GC in Livingston County.
